What it costs
How applying works
- 1The employer registers you in the March lottery (or files directly if cap-exempt).
- 2If selected, the employer files the petition with the wage level and occupation for your role.
- 3From India, after approval, you get the visa stamped at a US consulate. Students in the US can change status instead.
What changed recently
- 21 Sep 2025$100,000 payment proclamation takes effect for new petitions.
- 27 Feb 2026Weighted-by-wage lottery rule takes effect, used for FY2027.
- 8 Jun 2026Federal court in Massachusetts vacates the $100,000 policy.

- 24 Aug 2026DHS proposes a separate $103,265 cap petition fee.

Other routes
O-1A
For extraordinary ability with sustained acclaim. Up to 3 years at first, no lottery.
L-1
A transfer within the same company after a year with it abroad in the last three: L-1A for managers, L-1B for specialised knowledge.
EB-2 NIW
A green card route you can file yourself. India’s EB-2 final action date was 1 Nov 2013 in the October 2026 bulletin, so the wait is long.

Frequently asked
Do employers have to pay the $100,000 H-1B fee now?
Not at the moment. A federal court vacated the payment policy on 8 June 2026 and the appeals court refused to pause that ruling. The proclamation was renewed in September 2026, but a second court order blocks its implementation. The appeal is still pending.
How does the new H-1B lottery work?
From FY2027, each registration gets entries by its wage level: one at Level I, up to four at Level IV. Higher-paid roles are more likely to be picked, but the rule’s modelled odds are not a guarantee for any one person.
Which employers can sponsor an H-1B without the lottery?
Universities and qualifying nonprofit or government research organisations are cap-exempt. A company doing AI research does not qualify just because of the work it does.
