How applying works

  1. 1The employer registers you in the March lottery (or files directly if cap-exempt).
  2. 2If selected, the employer files the petition with the wage level and occupation for your role.
  3. 3From India, after approval, you get the visa stamped at a US consulate. Students in the US can change status instead.

Frequently asked

Do employers have to pay the $100,000 H-1B fee now?

Not at the moment. A federal court vacated the payment policy on 8 June 2026 and the appeals court refused to pause that ruling. The proclamation was renewed in September 2026, but a second court order blocks its implementation. The appeal is still pending.

How does the new H-1B lottery work?

From FY2027, each registration gets entries by its wage level: one at Level I, up to four at Level IV. Higher-paid roles are more likely to be picked, but the rule’s modelled odds are not a guarantee for any one person.

Which employers can sponsor an H-1B without the lottery?

Universities and qualifying nonprofit or government research organisations are cap-exempt. A company doing AI research does not qualify just because of the work it does.
